L1 to H4 to H1

Greetings!

 

I came to US on Feb 2008 with L1B VISA, with extensions I completed 5 years in Jan'13. Currently I am on H4 VISA and I'm planning to apply for H1 in 2014 CAP.  I will be on H4 for more than a year when I apply for H1 in 2014 April.

 

Here are few questions I have

 

1) Do i need to out of the country to apply for new H1 (as I already completed with my L1B)

2) If I can apply for H1B without leaving the country, how long I'm eligble to work?

 

Any suggestion would be much appreciated!

2. You cannot apply as you have not stayed outside US for 365 days.
