abcxyz07 Posted October 17, 2013 Report Posted October 17, 2013 Dear friends, Emp B filed my H1B and it got denied this year. I work for Emp A right now and he is going to file my H1B next year. Emp A does not know that my H1B was filed this year with Emp B and has got denied. My question is when my current employer files my H1B next year does he needs to mention that a H1b petition was denied last year or he does not have to mention anything when he files for a new H1b next year? Please let me know! Thanks
Attorney_10 Posted October 20, 2013 Report Posted October 20, 2013 Yes, this information should be disclosed. Form I-129 asks if the beneficiary has been given H1B classification or denied H1B classification in the past seven years.
