H1 Expire and working from India

Hi All,

 

if my H1 expire and need to go back to India for Visa renewal. let say if i need to come back in 1 or 2 months. Can my employer Run my Payroll for those 2 months? will it impact in future?

Not possible...moreover why would you want to do that? Will you be working from India?

When you are out of US you are no longer on H1B status. Running of a payroll is not necessary.

Your employment and payroll while in India is not a problem of US law.

How long have you been on h1? If it is less than 6 years and strictly a visa renewal, then yes your employer can run your payroll as long it likes
