kpotdar Posted October 17, 2013 Report Posted October 17, 2013 Hi My PD is current as of Sept 2013. Although I do not have my AOS approved yet, I wanted to find out, If I can file AOS or Follow-to-join for my parents if they are dependent on me. Any thoughts?
Belle Posted October 17, 2013 Report Posted October 17, 2013 No, your parents are not eligible to adjust under your I-140, so no following to join. You can sponsor them for permanent residence after you become a citizen.
catx Posted October 17, 2013 Report Posted October 17, 2013 A key point in Belle's post is "citizen". A permanent resident (green card holder) cannot sponsor their parent(s).

Attorney_15 Posted October 17, 2013 Report Posted October 17, 2013 Just as one is not a US Citizen until one has actually take the oath of citizenship, one is not an LPR until actually after the I-485 is actually approved. The law provides that a US Citizen can sponsor parents but not an LPR.
