Getting laid off, how much time on legal H1B status?

Hi,

  A friend of mine is getting laid off from his company. He is currently on H1B and his last date of employment is Nov 2nd. He has a valid H1B stamp on his passport.

1. How long does after November second before his legal H1B status expires?
2. After getting laid off and before his H1B expires, can he still travel outside of USA?

1. He is out of status from Novenber,3 unless he applies to change status to say H4 if applicable or B2 or he can discuss his problems with a Lawyer.

 

2. He can certainly enter on any valid visa like B1/B2 after leaving . He cannot use this H1 visa to come back until a new H1 PETITION IS FILED AND APPROVED.

2. Yes, he can. But, he cannot return without a new job and new I797.

Nov 2nd is the last day before your friend will be Out of Status...better not travel at this point.

Once laid off, you will be out of status. To avoid this file COS to H4 or B2, if not leave US ASAP.
