Motion to Reopen: new H1B petition

My new H1B petition got denied (EVVC Model) due to lack of Client Letter and work orders between the chain (Vermont SC).

Applied for 'Motion to reopen' with Client letter and work orders between vendors on August 28th, 2013. The status still says 'Initial Review' and 'we received this I290 B notice of appeal to commisioner and mailed you a notice....blah blah blah'.

 

Don't know how long its gonna take to process the application.

 

OPT extension ends in November first week. Got admission in a community college, will transfer SEVIS as soon as OPT ends and will stop working at client site.

 

My work contract renews every 3 months. So we submitted the paperwork (Client Letter and work orders) only for 3 months.

We are thinking of trying to request another 3 to 6 months extension and filing an amendment to 'Motion to Reopen'.

Is it a good idea? Any feedback is greatly appreciated.

Find another employer with min layers in between.

Just think practically, are you safe now?? Moreover, joining some college to stay in US is not a good idea.

Don't take anything for granted w.r.t immigration.

Thanks for the feedback. Since this is my new petition, filing through

another employer is possible only for next H1B year (i.e., April 1st, 2014)

(unless I try for non-profit institutions). I have already started search for a better

employer.

I have got an RFE wherein USCIS is asking my employer to provide work order and organisation structure. My employer is insisting to resign from my current job and is assuring (which is of no value) that they will be able to get it approved successfully by providing all the documents


 


Should I trust them and go ahead with my resignation or should I wait until it is approved?


 


Note: Both my current and future employer are reputed consulting firms. My first H1B was approved without any RFE
