Just want to know when we should ask employer to file for GC? Is there a specific time/period we have to remain on H1B before employer can file for GC, or can we ask employer so file for GC once we are on H1B? Please let me know. Thanks.
omshiv Posted October 14, 2013 Report Posted October 14, 2013 You don't ask! They would file when they want to. Moreover you have not even completed 1 month with them on H1b..asking them could be risky for you with even job loss.

If he is willing to hire you ask future employee then he will. An employer is not supposed to file your GC, everything depends on the employer whether he wants to or not.

Oh ok...probably I misunderstood. between the employee and employer..its the Employer who is supposed to file GC...that was the point I was intending to make :)

I have did my MS in US and i got a job on my first opt after 9months from opt start date. and my question is what date i need to put start date of employment on GC application with employer? worked with same employer from my first job (opt/stem ext opt/H1)

Here is an answer (rather than a moral judgement): There is no time limit. Yes, you can request your employer for GC, it is not illegal to do so. Your employer can file even on October 1.
