Dependent RFE on June 14th missed; saw yesterday

Dear all,

 

I have a situation here. My wife, dependent applicant, received RFE on june 14th, 2013 and very unfortunately we only saw it just yesterday, after 4 months. My PD is feb/2008(current). I made this mistake of not checking her case status like i do it for me. I last checked her status on june 10th a few days before RFE to verify the LUD on the address changed we both made at that time. We never received any letter for the RFE, nor my lawyers ever informed me. I called my lawyers several time since but since its a weekend nobody is responding. My I485 is approved and her current status shows as RFE.

 

Now, i am scared. Could her application be denied since no response to RFE? what is the best next step? What should we do? Thanks all.

If you have a lawyer, you are generally protected. If they screwed up your RFE (fell throught the cracks, literally), you can just claim ineffective representation, and go on with the case. That's the worst case. However, it does not seem like there is anything serious, since your wife's case has not been denied. Let the lawyer call the USCIS and find out what happened to that RFE.

I don't know the answer to your situation. Perhaps involve another attorney if your current attorneys aren't responsive and act immediately. 

 

What I wanted say though was that you can register an account on USCIS's case status website and add all cases, including for dependents, to the portfolio for that account. That way you can see all/any updates in one place. Just an FYI - for future case monitoring.

Thanks Belle and StressedAbtGC for your reply. Called USCIS @ 8 AM in the morning byt they are closed due to Columbus day. Then I was busy the whole morning with my lawyers. It was a mess but the end result is good. The lawyers i dealt with were replaced with a whole set of new lawyers and yes they got the RFE but luckily they also got an ignore letter 2 weeks later saying the first one was sent by mistake. Since it was a secondary applicant and whole set of new lawyers, they missed to inform me. But nevertheless i am relieved now as the situation is okay. Now my new lawyers are tellling me they will reply to the USCIS to approve my wife's case as I got it approved already.

 

Yes, StressedAbtGC, I should have added my wife's case to the automatic text and email update which i have it for my case. Lessons learnt. Thanks.
