H1B Unused - Consular processing - One year outside US - L1 to H1 Transfer

Hello ,

 

I have a Question regarding H1B Cycle reset. I have seen other posts related to similar problem but My problem is different than other postings

 

Any help is greatly appreciated in this regard.

 

Following is my Case.

 

> I worked on L1B Visa for Company A from JAN 17th 2007 to OCT 31st 2010.

 

> While I was in US, Company B processed H1B with Consular processing which can not be activated without getting VISA.

 

> I went to india for stamping but could not get stamped and Stayed in India for 18 Months with same Company A

 

> I came back to US on JUL 2012 on L1B from Company A.

 

> Consulate has considered the cycle reset and issued my L1B till 2015 Apr.

 

> In JUN 2013, Company C has applied for a Cap exempt H1 based on my Unused H1 and never activated H1 applied with consular processing

 

> USCIS has not considered my Stay outside in US and issued me only 1+ year of extension. Company C attorney is still fighting with USCIS for a cycle reset as My First H1B was applied with consular processing and never activated.

 

 

Please let me know if the cycle reset should be considered because my H1B was applied with Consular processing.

 

If cycle reset is not an option, I need to look for a company who can process my GC at the earliest as I have only one year of stay left in US.

 

Again, Any quick reply is greatly appreciated.
