My opt is valid till June 2014 and Visa is valid till 2016,I am going to file my H1 petition through my current employer coming March/April 2014. Will there be any challenges at the Immigration every time I reneter th states since I have 8 months of OPT remaining?
t75 Posted October 13, 2013 Report Posted October 13, 2013 Time outside the US is typically unemployment which is limited. You need to consult your employer's attorney since it is very unusual for an OPT student to be placed at a client outside the US by a US based company. The fact you require a Canadian work permit also likely has an impact. WHy do you need to travel to the US? Your project is in Canada.
catx Posted October 13, 2013 Report Posted October 13, 2013 A few of the notable relevant questions are who do you work for, who do you report to, where are you getting paid, where are you paying taxes?
