My wife who is on H4 enrolled into an MBA program this fall (in a genuine university). We are planning to apply for a change of status for her to F1. As it will take two years to finish the program, there are high chances that we will visit our home country and in turn get our stamping done. My questions are below · Will she have a tough time facing F1 interview? I understand that F1 is a single intent visa and H1 is a dual intent visa. Now that the officer knows that she moved from H4 to F1, will the officer question her on immigration intentions (like have you or your husband applied for GC, how do you plan to comeback, etc)? · Will this have any effect on our GC process? · Also, the program requires her to do an internship in summer. If we clear all the school rules (like full time for an year, etc), can we apply for CPT? I have been hearing a lot about of CPT abuse and I don’t want to do the same. t75 Posted October 11, 2013 Report Posted October 11, 2013 An internship that all students must participate in is not an abuse - put a very appropriate use - of CPT. She must answer visa officer's question truthfully.
p31 Posted October 25, 2013 Author Report Posted October 25, 2013 Thanks for the replies. My company attorney mentioned that theoretically, you can not say that someone has applied for a GC until he/she applies I-485. Is that true?
