H1b transfer while I am in india

Hi All,

 

 I already have A h1 visa with company X stamped.I am still in india.

Can some other company y(like congnizant or desi consultin company) do H1 transfer when I am in india?

If it(Y company) does the transfer,Can I go to US on Company X visa?

 

 Note: My visa(on company X) is valid till 2015.

 

I heard lot from lot of guys,If I want to work for company Y I need to just have the H1B transfer.

I can go to US on company X Visa and work for company Y.I don't need to attend the interview for company Y because my company X visa is still valid to enter into US.

 

Can anybody clarify about this?

Yes...any company can do a H1 transfer while you are in India..I wouldnt advice you to join a Desi consulting company though.

 

You can travel on the same existing Visa...but at the POE you'll need to show all your new H1 related documents...and provided you have a job there...else expect a deportation.

Have you travelled to US using X's visa? If not, then you need new visa from Y...but please let others comment.

Yes, that's correct. At POE you need latest 797 and a valid visa, of course employment letter.

You can travel to US, with company X visa and company Y approval. But better attorney should confirm about it.

Firstly it is not called a transfer. Secondly you have been capped and hence any other company can file and get your H1 petition approved. The company will tell you if they need a new visa or not.

  I need your help to come to conclusion so that I will have confirmation on one thing.

 

Note: I have not travelled to US on company X(present company visa) that means I have not yet worked in US on company X visa.

what I understand from you is :   I need to have H1 transfer approval documents from Y and job offer and LCA to the particular client.

 

Then I can travel on existing visa(company X visa) and show the above documents of Y at the port of entry.

I don't need to attend any VISA interview for company Y.

 

I want to come to come to final conclusion by this.Can you confirm about this?

Yes, you can. You need your old company's unexpired visa and company X's  I797 document.

My present Status :  I specified present company as X(with whom I am working in india and  I have the present visa with them till 2015) and Company Y with whom I want to have h1 transfer.

I have not yet travelled to US on presnt company(X's) Visa.I want to have transfer while I am in india.

 

 Final Conclusion based on which I can take decision: 

 

 I can have H1 transfer(approved I797) from Company Y while I am in india and I can go  to US on unexpired(Company X's) Visa.I will(should) not have any problems at Port Of Entry (POE).Then I can work for company Y without any problems.
