I do have a court certified copy of dismissal with me. i have mentioned about this record in DS160. will this delay my visa stamping in any way? I have my stamping on 15 oct in kingston, jamaica
pontevecchio Posted October 9, 2013 Report Posted October 9, 2013 Unless your case was dismissed by a judge you should reconsider the visa application. A rehabilitative disposition would still mean medicals and a delay.

I have my stamping on 15 oct in kingston, jamaica As far as I know they are not even opening the ds-160...so it shouldn't be a problem...But as you know its depends on your luck too....
sk9683 Posted October 10, 2013 Author Report Posted October 10, 2013 thanks for the replies. my case was dismissed by the judge after completing the one year pre trial divert program. only thing i am worried about are my finger prints. they would know that i have arrest record, so more questions will be coming my way. my dwi attorney and immigration attorney say that i dont have a problem as long as I have the court certified disposition copy. hope everything goes well.

pontevecchio Posted October 10, 2013 Report Posted October 10, 2013 Please be aware that there will be a hit on coming back. If the arrest was not mentioned at the visa Interview this risks a life long ban. If the arrest was mentioned then there is no way in hades they will ignore it.

I am prepared for that. carrying all the necessary documents to show that my case is dismissed and i have no pending records. thank you @pontevecchio

sk9683 Posted October 21, 2013 Author Report Posted October 21, 2013 guys, I got my visa approved on Oct15th without any issues. they did ask about my DWI, when they saw the certified dismissal copy, it was all good. I requested for passport to be given the next day. within two days i got back to the states.I was not asked for any medicals. At Miami port of Entry I was taken for a secondary check on my finger prints and after verifying i was let go. I guess everything should be ok as long as you have all the paperwork to support your case. good luck

I was granted Dui diversion and was on probation for 1 year and my license was not suspended. I have paid all fees and attended the classes am out of probation 4 months ago.Am planning to for stamping(h1b) to Kingston,Jamaica very soon. I have all the papers(arrest related,classes completion ,out probation) ,as of now i dont have any papers from court that the case was dismissed but have a letter from my probation officer that i have sucessfully completed my diversion. Can you suggest me something ,am very nervous ???

I am done with everything like DUI Classes and Community service but I am still paying the fine through payment options and will get it done by this month. After i pay the whole fine amount i will collect the papers from Court that says my case is closed and dismissed. Now that i am working as a full time employee for a big company in California itself. My question is, I want to know in which case they ask for Medical Exam and which case they don't. I heard if the DUI is with in last 12 months, they ask for medical exam. Was your case just a random one, or they never ask for Medical Exam in Jamaica as long as you submit case dismissal papers. Please share your thoughts. --prasad

Here is my case : March 2nd 2013 : Arrested for DUI in california August 27 2013 : Pleaded guilty Dec 23 : completed dui classes jan 7 2014 : got my license back. April 28 2014 : visa interview in jamaica. VO referred me to medical panel May 8th 2014 : followup appointment , no questions asked ,visa approved and got the passport same day. Port of Entry : took me to secondary check and again no questions asked.

He was asked to take the medicals and he submitted the documents on Nov 20th . They just asked to check the status in The tracker which shows administrative processing.
