atulmagoon Posted October 8, 2013 Report Posted October 8, 2013 Hi, I am on F-1 visa and I will fall under Masters cap for H1B lottery next year. I was wondering if I have two jobs at two different employers by Feburary 2014, can both the employers file for my H1B? What will have if I get selected twice? I am trying to maximize my chances of getting H1B and I am not sure whether it is appropriate to file for 2 H1B applications. Thanks.

You have to choose one and join that employer by 1st oct 2014.
omshiv Posted October 8, 2013 Report Posted October 8, 2013 Yes, both employer can file for your H1B..no issues there.
atulmagoon Posted October 9, 2013 Author Report Posted October 9, 2013 Thanks for your response. My OPT will expire by June 2014. My follow up question is that will I get H1B gap period for both the companies i.e. can I change job between April 2014 and October 2014.
t75 Posted October 9, 2013 Report Posted October 9, 2013 You may have contractual obligations to both and could be sued for liquidated damages for failing to appear for work.
