H1B expired petition

Hi All,

 

I had a H1b petition approved in sep 2009 and expired in 2012. The petition was filed when I was in India and I never went to stamping in India as the company which filed my h1b was shut down due to recession. Is there a way I can file new H1b or transfer h1b with a cap exemption.

Yes, a new employer can file a cap exempt H1B petition. Talk to immigration attorney of new employer.

you do not fall in the quota..your new employer can file for your H1b anytime.
