vinodyours Posted October 6, 2013 Report Posted October 6, 2013 Hello, I came to US last year Apr 2012 on L1 with employer A and another employer B applied my H1B this year and it got approved in the month of May 2013. I travelled back to india for a month in sep 2013 and came back to US on Sep 29th 2013. My new employer B filed my H1 B with COS from OCT 1st 2013. I want to know does my status changed to H1 B now even I got new I 94? Is there any way that I can check my current status? If I go out of US and return back on L1 will it effect my H1 any way? I want to continues with my new employer for some more time on L1 and move to H1B after 3-4 months . Will I need to face any legal problems ? Will my h1 b will be valid after 3 months ? If I go for H1B stamping after any year will there be any problems? Thanks for the early response !!!

If your COS from L1 to H1B got approved before your travel to India you are in H1B status from Oct 1st 2013. If you would like to continue of L1 you have to exit now and re-enter with L1 visa and obtain L1 I94. Once you are ready to work for your new employer on H1B either your new employer has to apply for a COS again (pay H1B fees) or you could exit and enter with a H1B visa. There will not be any problem if you go for H1B stamping anytime based on this.
