H1B Denied this week, Does MTR or an Appeal gives you the option to work?

Hello all,

 

Current Status: F1 VISA with ext OPT, Expiration Date: 1/1/2014

H1B Denied after responding to RFE. 

 

I would appreciate if would answer the following questions.

 

If applied for MTR/ Appeal,

 

Will I be able to stay in US after 3/1/2014( As per law you get 60 days to remain in this country after the OPT/EXT OPT is over)?

 

Will I be able to work after 1/1/2014, and till I get the result for MTR or an Appeal?

First, the H1 is the employer's application. You need to stay out of this.

Second, what would be the basis for an MTR or appeal?

Third, a frivolous MTR or appeal doesn't give you any rights to stay or work.

You cannot work after your OPT expiration since your H1 was rejected.

Let's forget about MTR, what's the reason for your H1 rejection??
