ravipasupuleti Posted September 24, 2013 Report Share Posted September 24, 2013 Hi, I got my H1B sponcered by company A, recently took a Full time with company B and my H1B is in processing with USCIS. In February 2013, company A filed my labor for PERM and is in processing. They approced me last week to sign ETA 9089 as there was an Audit and the Attorny requested the same. Company A claims they are comfortable to process my PERM ( due to the rapo I had with them ). Question : Is it legal to continue with my PERM processing with company A even though my H1B is in the process of transfer to company B. If everything turns out positive, can i transfer my I-140 at a later point to company B. Please suggest. Link to comment

pontevecchio Posted September 26, 2013 Report Share Posted September 26, 2013 A can decide to continue the PERM if they choose. You cannot transfer an I-140 though you can retain the PD for a subsequent filing. Link to comment
