umdtao Posted September 22, 2013 Report Posted September 22, 2013 I am on F1 visa, got H1B approved to work for Employer A from Oct. 1st. But I found Employer B, they just filed a new H1B application for me last Friday. If by Oct.1st, H1B for Employer B is pending, what will be my choice?(1) Start working for Employer A from Oct. 1st? ( I really want to avoid this, because it is very weird)(2) Start working for Employer B?(3) Stay at School by changing H1B to F1?Thank you
omshiv Posted September 23, 2013 Report Posted September 23, 2013 Ask employer B to PP. Although you can officially start working with just the Receipt from Employer B, I would suggest to wait till the approval. Option 3 is a No No.

Thank you If your F1 to H1B was a change of status then you have to start working from Oct 1st for employer A.
umdtao Posted September 24, 2013 Author Report Posted September 24, 2013 Ask employer B to PP. Although you can officially start working with just the Receipt from Employer B, I would suggest to wait till the approval. Option 3 is a No No. The filing is PP, it is still "Acceptance" status now. Are you sure "I can officially start working with just the Receipt from Employer B"? Company's attorney said so, but some other attorney said H1B COS has to have approval notice

Are you sure "I can officially start working with just the Receipt from Employer B"? Company's attorney said so, but some other attorney said H1B COS has to have approval notice Only if you are currently on H1B with employer A and moving to employer B you could start working for employer B with receipt notice. Since you are currently on F1 you need to wait for approval.

pontevecchio Posted September 25, 2013 Report Posted September 25, 2013 You would have up to 60 days to report for work in any case. Has the new petition been filed with PP?
umdtao Posted September 26, 2013 Author Report Posted September 26, 2013 Yes, It has been filed with PP, where can I find the "60 days" rule?
