aspramana Posted September 19, 2013 Report Posted September 19, 2013 Hi, I attended my visa interview in July. I got RFE on counter and they taken my documents. In August, i got email from consulate to send my passport for visa. I sent my visa. They issued visa and sent the passport to VFS for pickup. I went to VFS office pickup passport. The counter guy told me, your passport is returned back to consulate upon their request. After a week, i got my passport with "Cancelled Without Prejudice" on my visa. Now when i check my case online, it is saying "Administrative Processing". I am on H1 in USA from 2006 to 2008. That visa, H1 got expired and I applied new H1 from new employer under premium processing. Can you please help me what might be the reason for "Cancelled Without Prejudice" and what it means and what is the solution for this? I appreciate your responses. Thanks, Sri
WolverineS Posted September 19, 2013 Report Posted September 19, 2013 Found this online A stamp an embassy or consulate puts on a visa when there is a mistake in the visa or the visa is a duplicate visa (two of the same kind). It does not affect the validity of other visas in the passport. It does not mean that the passport holder will not get another visa. http://travel.state.gov/visa/frvi/glossary/glossary_1363.html

You said the visa is expired. "I am on H1 in USA from 2006 to 2008. That visa, H1 got expired". Isn't this visa that was canceled? If it was the new visa (as you went for interview in July 2013) for stamping there is a possibility that by mistake they would have approved it and now to rectify they would have "canceled without prejudice". And, probably that is the reason why your application is still under administrative processing. You just have to wait for them to finish administrative processing. Unfortunately no time limit for that.

When my employer asked USCIS, they said, they did not got any query from Indian Consulate. Now where I am !!!
