Company B applied H1B (COS) and get approved on Oct 1st 2012 with I-94. But I went back to India on 10/13/2012. And Company A applied L1B once again and get the L1B Approval on 11/13/2012 and cam back to USA on L1B. I have the following questions. 1. is my H1 is vaild now. 2. Now can I change from L1 to H1? If yes, what are the steps I have to take. 3. If my H1 is not valid then can I apply for COS from L1 to H1. Please answer for the above questions. Thanks in Advance.

(1,2 & 3) An employer has to file a cap exempt H1B petition (COS from L1B to H1B) and on approval you can start working for new employer
vin6381 Posted October 3, 2013 Report Posted October 3, 2013 Hi All, I am currently working for company X on L1 B and my L1 is valid until Feb 2014. And recently I got a H1 approval from a different employer on 1st October 2014 with COS. Due to some personal reasons I would like to Continue with company X on my L1B. Is there any way to do that? Can I do this by going to India and coming back on L1B?

Please note that, assuming you meant to write Oct. 1 2013 (not 2014), if you are still working for the L-1 employer, you have likely already violated your status.
