h1busybee Posted September 19, 2013 Report Posted September 19, 2013 Hi, I am currently working for Company A and I got a job from Company B. Both are fortune companies. Company B applied for H1B transfer through premium processing. The H1B transfer is approved and Company B's attorney received an email confirmation of the approval. Hard copy of the approval is not yet received and USCIS online status is in "Decision" and not yet in "Post Decision Activity". Question : Is the Approval Confirmation email sent to Company B's attorney good enough to resign from my current Company A?? Or do I need to wait for anything else? Please let me know. Thanks,

rahul412 Posted September 19, 2013 Report Posted September 19, 2013 I guess that should be good to go...!!!
h1busybee Posted September 19, 2013 Author Report Posted September 19, 2013 Rahul412, Did you mean that I can resign now? with just the approval email??? The previous poster jairichi has a different view. Do you think things might change even after getting the approval email. I heard the approval letter might take almost a week to reach me. Let me know.

You are allowed to work immediately after approval. If you are not in a hurry you could wait for approval letter. That is why I said after receiving approval letter

Since you have a soft copy I think that should be enough for you to join the new employer without any status problems.
downbutstanding Posted September 20, 2013 Report Posted September 20, 2013 Hi, Get the transfer process started with 2nd employer, get the receipt number and then resign from current employer to be on safe side. Thanks.
downbutstanding Posted September 20, 2013 Report Posted September 20, 2013 Not sure about with the approval email. Wait for soft copy from attorney/employer or the hard copy of the approval notice. Thanks.
jairichi Posted September 20, 2013 Report Posted September 20, 2013 Hi, Get the transfer process started with 2nd employer, get the receipt number and then resign from current employer to be on safe side. Thanks. Kindly do not advice anyone to resign based on receipt number. There are posts in this forum where they have resigned based on receipt number and got stranded as their H1B petition with new employer was denied.
h1busybee Posted September 23, 2013 Author Report Posted September 23, 2013 Hey Guys, I resigned after I got approval email. Thanks for your help.
downbutstanding Posted September 24, 2013 Report Posted September 24, 2013 Kindly do not advice anyone to resign based on receipt number. There are posts in this forum where they have resigned based on receipt number and got stranded as their H1B petition with new employer was denied. Sorry about the wrong advise. Get the approval from the new employer and then only resign if you want.
