Hi Experts,

 

You all are doing a great job helping many and responding to their queries. Here I am the one who falls into the 221 g bucket.

 

Here is the brief of my case

 

I am working for big MNC A in India.

 

I got selected for companyX i US and they had applied for my H1B in 2012. I got approved petition papers from  CompanyX US with all docs including client letter,offer letter and all in oct 2012 and i was asked to go for VISA interview.

 

As i am working in India for companyA, companyA asked me to go to UK for some urgent project delivery. At that time i informed companyA about my H1B of companyX. Then companyA requested me not to go for Visa stamping through companyX. They also told me, go for UK project and in the mean time we will transfer companyX H1B to companyA H1B. I agreed upon that. CompanyA filed for transfer and that also got approved from USCIS.

 

I returned from UK and i attended H1B VISA interview on behalf of companyA.

 

I have taken both the companies approved petition papers to interview. VO didnt ask me anything. VO told me that companyX had revoked your petition and your attorney needs to talk to USCIS. He told me that iam ineligible to enter US. I am shocked and as it was my first interview i didnt ask him anything.

 

After 2 mins,he himself asked me can i apply for a waiver. To be blunt i dont know what waiver is. I thought he is kind of helping me somehow i said yes. Then he returned my PP back and issued me 221 g white form with " Your application needs further AP to take final decision" check box ticked.

 

Nothing was written on the form. Not even the case number.

 

I have checked the status online with DS 160 form Application ID.

 

It always says its undergoing AP. But Status updated date has changed around 5 times from the day of interview till today which is exactly 3 weeks.

 

Please suggest me whats is going to happen in my case with your past experiences.

Nothing was kept with VO. He had returned back all the things.

 

I attended interview in Aug 2013 at HYD consulate.

 

Note : I didnt go for VISA interview through companyX. I just got approved petition papers from companyX and after that that had been transferred to companyA. I attended interview on behalf of companyA.

Your case looks straight forward with no issues I could think of with what you have mentioned. As your application is still under administrative processing you just have to wait. Contact your employer A's attorney and see what he/she has got to say.

The status update date has changed five times so far ,but they didnt ask me anything and they didnt contact me through email or mobile.

 

So with this can i think that they are working on my case or status update date will change simply without working also?

They will be working on your case. But, as I said earlier do talk to your attorney asap as I am a bit concerned of VO saying that you are ineligible to enter US and asking for a waiver, which I do not understand.

I do not know. The only thing that pops in my mind is could the word be withdraw instead of waiver?

Also, there is a possibility that VO just considered or saw I797 approval notice from employer X and not A. And. since it was revoked that would have prompted this outcome as either waiver or withdraw.

Interview on 27Aug2013,HYD consulate. 221g issued with nothing asked. Returned all docs nothing was kept with VO.

Did you give the VO your companyX I-797 instead of companyA I-797? As you have appeared for interview from companyA with their approved petition VO shouldn't say your petition as revoked...as per my knowledge your interview assessment should be solely based on approved petition of companyX...

Hi hicopicobm,

 

I gave Company A s I 797 only. I didnt take out Company X s one also and he also didnt ask me Xs.

 

He looked in the system and said that X had revoked my petition. My company VISA team is saying that dnt worry u will get it as everythng is good with u. But only time matters they said. wat do u say on my chances of getting VISA. Company A is goood MNC and iam working from 3.7 mnths.
