L1 B extension -RFE

Hi,

 

I am on L1B, my I94 expired on jun 5 2013, L1 extension was filed and got RFE, 

 

I know that if the decision is rejected, the stay from the day after I94 expired until the day we leave US is treated as out of status.

 

I just want to know what are the possible issues one will have because of this.

You will be forced to attend visa interview by USCIS by rejecting COS when you file for new status or ext.

It will, if your stay is beyond the I94 expiration day and current legal status is unknown.

what kind of effect ? will the subsequent visas will not be approved/issued because the person over stayed beyond I94 date/ illegal status ? we have a valid reason for the stay ( petition pending).

 

I can see in from the forums that most of them are in the similar situation. I think this applies to most of them.

If your petition is pending and your I94 is expired,still you can stay in US legally until a decision has been made.

It effects only if none of your petitions or applications are pending and your current I94 is already expired. Got it??

Because you doesn't have any status from date of rejection to Sept 31st. That's nothing but out of status.
