imnonimm Posted September 17, 2013 Report Posted September 17, 2013 Hello, Can we file second I-140 after six months validity of PERM as first I-140 was filed within six month validity of PERM and denied? If yes how late we can file second I-140? Really appreciate your help. Thanks
JoeF Posted September 17, 2013 Report Posted September 17, 2013 Hello, Can we file second I-140 after six months validity of PERM as first I-140 was filed within six month validity of PERM and denied? If yes how late we can file second I-140? Really appreciate your help. Thanks No, you can not.
imnonimm Posted September 17, 2013 Author Report Posted September 17, 2013 Why was it denied? Due to discrepancy in company financial documents and company not willing to do audit now, rather they are thinking of re-file I-140 based on this year tax returns.
imnonimm Posted September 17, 2013 Author Report Posted September 17, 2013 No, you can not. Some forums/friends saying that " If I-140 was filed while PERM was valid then PERM is never considered to expire if I-140 needs to be filed again" Please somebody suggest!
schintala Posted September 17, 2013 Report Posted September 17, 2013 I am sorry to hear on your I140 denial. What is the reason for denial. Based on that your attorney can guide to refile or appeal. PERM expiration applicable only to initial filing.
