H1B for City Government Job

Hello all,

 

I graduated with Master of Public Health. I might get an offer from one of the City offices and the position is Public Health Specialist. They do not know the process of H1B application. I have to do it by myself. They said they are non profit but do not come under 501© kind of non profit. My question is if I have to do the H1B by myself, how should I take care of application fee and premium processing fee (method of payment)? I tried to search for salary requirements for the position, but could not find any information about it. What is the best website I can find information about salary requirements for H1B? I would also like to know the best lawyer to represent my case at USCIS (I know this is a law forum but like to meet the lawyer personally. I prefer someone in midwest). The position involves little bit of research. (I was told only research positions in government or non profit organizations are eligible to get H1B approved without cap quota). Im currently on F-1 status. I lost one job in the past due misinformation from the lawyer to the employer (I never applied to H1B. This might be my first time H1B application). I am looking into future and posting these questions. Any help in this regard is greatly appreciated. Thanks in advance.

Only the employer, as the petitioner, can file the H1B application on behalf of the employee / beneficiary. The Department of Labor considers the costs of an H1B petition to be an employer's business expense. As such, the employer should pay all costs associated with the preparation and filing of the H1b petition, including legal fees and USCIS filing fees. Furthermore, there are certain fees which can only be paid by the employer. Please schedule a consultation with a qualified immigration attorney to discuss the specific facts relating to your case.

@ Attorney_10 - I am not sure whether my future employer will be having funds associated for H1B petition. I guess I have to pay all the expenses. Are there any other possibilities to pay expenses, if I am bearing those expenses? I was told we can get money orders for application and PP. In most cases legal fees can be paid by petitioner, at least thats what I heard from most of the people.

ABSOLUTELY NO. You can not pay H1B fees. It is against law and you will be in trouble for breaching law.

I would advice that both you and your employer speak to the Attorney at Murthy Law firm to get a clear understanding of H1 laws.

 

Jairichi is absolutely correct..you cannot pay the H1B fees.

As omshiv said both you and your employer needs to speak to an attorney. And, be assured that being a government agency they would never violate any law and force you to break one.
