ranji123 Posted September 16, 2013 Report Posted September 16, 2013 Hi I have a Masters in Chemistry and have been working as a software engineer for 3 years on H1B. I had maternity break and applied for a new H1B petition (cap exempt as I holded a H1B) and this was denied. My company want to re-apply new H1B petition and I want to know the risks ? Do I get flagged/ bad record if I have mutlitple H1B denials ? What would be the best way to re-apply ? I have 16 credits during my masters which was all computational chemistry and programming and my Professor/Dean can provide evidence. But would this be sufficient Do I need to take up 15 credits Computer science certififcation from accredited university/extension colleges Thanks for your help RR

Any number of petition would result in denial. Wait for other members opinion.
omshiv Posted September 16, 2013 Report Posted September 16, 2013 How can you be doing coding when you have done your specialization in Chemistry?
bhalc Posted September 16, 2013 Report Posted September 16, 2013 Another petition will make your case worst. Try to get into the related field.
rahul412 Posted September 16, 2013 Report Posted September 16, 2013 What would be the best way to re-apply ? Thing s won't change.Because the reason for denial is your educational BG and now if you file for new H1 it will be the same educational BG. Better to consult an attorney.

You don't have a CS degree, therefore it is pretty much impossible to get an H1 for CS work. Find an employer in the field of your degree.
ge145 Posted September 17, 2013 Report Posted September 17, 2013 I think you need a better lawyer You havent mentioned that you were in MS category for H1 or not Assuming not, if USCIS approved 3 yrs ago, a good lawyer can use it to your advantage.
