srini2k13 Posted September 16, 2013 Report Posted September 16, 2013 Fellow experts - Need your expertise, experience and suggestion(s) I have started GC process in 2003 and applied for AOJ in June 2007 and its been pending since. A week ago i have received an email from USCIS that a RFE was issued, yet to receive/view the mailed documents. But...due to family problems and priorities i had relocated to India in 2010 and haven't visited USA since. The RFE sparked to re-think about GC possibilities. I am working for the same company in India that has filed GC in USA with same roles and responsibilities. With all the issues, i wasn't focused on applying for Change of Address after moving to India. Considering this situation - Am i still eligible to respond RFE? If so, how to proceed from here. Please share any of your experience who might have been in this scenario or any advice is appreciated. Thanks, Srini
omshiv Posted September 16, 2013 Report Posted September 16, 2013 I believe you have abandoned your GC process...you should have converted it to CP... but wait for other member's opinion. I also think you meant to say AOS instead of AOJ..I dont know what that means.
Belle Posted September 16, 2013 Report Posted September 16, 2013 Did you have a lawyer when you filed I-485. Assuming you did not change the lawyer, they still have to represent you to some degree, and they have to act in your best interests. You can either ask that lawyer to represent you or hire a different lawyer (the old lawyer will have to trasfer your case), but you certainly need advice on how to switch to CP. Since you are with the same company, it should be possible.
