Chipps1983
Hello, I am working for X Company and holding H1B approved petition (Valid till 2015). I had travelled for short duration and got my SSN as well. Currently in India, working with the same X Company. My company do not have long term project for me and there are no chances in near future may be 1 Yr. I started looking for a company which will to process H1B transfer. During the search, one of consultancy contacted me and they say that I can travel on current visa and they would provide their company offer letter and client letter. As far as I know it is not legal to travel but I got below link which says one can travel on current visa though one is no longer working for same company. Please give me proper guidance. http://www.************/visas/h1b/admission-at-port-entry-h1b-portability.html Link to comment

If you are caught at POE lying then you face deportation and life long ban. Find an employer who would file a cap exempt H1B petition and upon approval travel to US. Link to comment

omshiv
As Bhalc adviced...stay away from Shady employers who give you advice for their benefits and do not care about your Visa status. Although its fine to travel on your previous employer's Unexpired Visa..you would need to carry all your current H1 documents and have a Valid project in the US...else expect to get Deported. rahul412
In this case, either employer is shady or doesn't have enough knowledge about H1 immigration rules. How can a person enter into US without a valid 797?? Link to comment
