Need urgent help -- Salary lower than LCA

Hi,

 

I need to travel to india urgently and will need to go for H1b stamping.

 

However, My LCA states an annual salary which is $2k more than what I receive in monthly pay.

 

What salary should I mention on DS160, should I mention my actual salary or the salary mentioned in LCA?

If I mention the LCA salary then I do not have the paystubs to support it.

 

Will the VO be aware about the salary on my LCA, If I just mention my real salary on DS160.

 

Please let me know asap.

You need to mention the salary you receive. Yes, there is a possibility that VO will cross check your LCA against the salary you obtain. You will be in trouble.

Of course vo knows your LCA salary. Your employer has submitted that LCA to USCIS so obviously they know LCA salary and moreover you have submitted your LCA during the interview. So don't mess up the process.

 

You are in trouble for not getting paid according to the LCA document and therefore you are out of status for not getting paid as promised by your employer. The ONLY OPTION now you have is to file a complain against that FRAUD employer for not paying you whatever he promised to pay .
