myravi905 Posted September 11, 2013 Report Posted September 11, 2013 I am working on L1 in Company A and my I-94 is expiring in December 2013.Company B applied for H1 and it is approved and is valid from Oct 1st. ( Change of status is approved ). approval came with I-94. I don't have a project ready to join Company B. Do I need to quit Company A effective October 1.Can I continue to work on L1 in Company A till I get a project through Company B.What is my sistuation from after October 1. Please suggest at the earliest asap. I am in dilemma.

Please suggest at the earliest asap. I am in dilemma. If you do not join company B on Oct 1st you will be in illegal status. If you want to continue with company A on L1 then you have to exit and enter US on L1 just before Oct 1st. But, later when your company B is ready with a project for you then your company B has to file a cap exempt H1B petition (COS from L1 to H1B) and pay again H1B fees. Upon approval of COS you can start working for company B.
