sujamana Posted September 11, 2013 Report Posted September 11, 2013 Hi I am working with this company for 9 months (they sponsored my H1B) and last week I had submitted resignation to my employer due to personal reason with a notice period of 2 weeks ending by this week. But my employer is not ready to accept my plans and he wanted me to serve for 4 to 6 weeks which includes transition. I am open and flexiable and i can convince my other employer to work for another week after 2 weeks of notice with my current employer to complete the transition, but really not ready to serve 4 to 6 weeks notice as they expect. My concern, if I choose to leave the company after 2 weeks of notice, will there be any issues personally affecting my stay in US (visa and career point of view)? Would really appreicate if someone had experience early this situation, enlighten me Thanks in advance -sujamana

If your contract says a 2 week notice period you are good and nothing to worry about. And, check whether your current employer has mentioned about claiming damages if you resign within 12 or 24 months. We see a lot of posts recently like that. Also, if you have a H1B petition approved with another employer there is nothing to worry.
omshiv Posted September 11, 2013 Report Posted September 11, 2013 Sujamana - Nice name if thats your real one. Anways does your contract of your current employer say anything about Notice period? if not..then just ignore their warning and join the new employer whenever you are ready.

sujamana Posted September 11, 2013 Author Report Posted September 11, 2013 I didn't sign any contract other than my offer letter, which doesn't mention anything of this sort.
sujamana Posted September 11, 2013 Author Report Posted September 11, 2013 I didn't counter sign anything except the offer letter, but that doesn't have any clause of this sort
rahul412 Posted September 12, 2013 Report Posted September 12, 2013 I didn't sign any contract other than my offer letter, which doesn't mention anything of this sort. Okay, that's good.Does that signed letter says anything about notice period? If nothing is mentioned then you are good to go..!!!
omshiv Posted September 12, 2013 Report Posted September 12, 2013 I didn't sign any contract other than my offer letter, which doesn't mention anything of this sort. Then just Ignore them. 2 weeks Notice period is the norm here.
