Chowdhary Posted September 10, 2013 Report Posted September 10, 2013 Hi, Currently, I am working for a client through my employer whose has 3 layers in between (client and my employer) among 3 Vendors, one of the Vendor is Implementation partner to the Client. Previously during my H-1 processing I had requested the Client to provide a Client Letter mentioning my name, my employer and client ( excluding all the layers in between including implementation partner). The client had agreed for it and provided the client letter as requested. Now, I am planning for H-1B Stamping at Canada. So, will there be any issues or queries/rejections on my H-1 B Stamping if i take the client letter in the similar manner which I did during H-1 processing ? Or Do I need to include those 3 layers in between my employer and client in the Client Letter ? As I mentioned earlier, among 3 Vendors, one of the Vendor is Implementation partner to the Client. He refused to provide any supporting documentations for me during my H-1 B processing and at that time Client had supported me with all the documents I requested. I think he will do the same even now for my H-1 B Stamping. Please advise me, on this either to get a client letter with Vendor details or without Vendor Details in it. Which one is best way to avoid rejections/queries ? I will be very thankful for your advises...........
permaudit Posted September 10, 2013 Report Posted September 10, 2013 This is not to scare you with anything but a genuine effort to make your H1 process/life easier in terms of interview. It is always better to go for stamping with a max of 1 layer and not more(Atleast think of it in future) Now that you have already got the approval based on the client letter, make sure that you have the same letter dated beteen 30days of the interview. Stick to the truth during the interview. All the best! In general terms, the VO will completely base the interview on the relationship between your employer and the client and will emphasize particularly on who is controlling your work, pay hire/fire formalities etc. It needs to be your employer alone and no one else.
