My GC process has started and currently we are waiting for "Prevailing Wage Approval", after that the AD & interviews will also take approx 3months. My company has lots of process before they file the PERM. So, based on the projected timeline- looks like all these pre-processing will complete by 31-JAN-2014. And then they will file for my PERM on 7-FEB-2014. Will it do any good to me? Leaving US for a year is not problem. My question is- can my company file for PERM if I leave US (on 31-JAN-2014). Please suggest. Thanks.
Attorney_11 Posted September 11, 2013 Report Posted September 11, 2013 Yes. A PERM Labor Certification does not require the beneficiary to be present in the United States to be filed.
