My employer prepared a contract that I cant leave him before 1 yr, if I leave I have to pay him $20k. I checked with few people, they say there is no value of contract here. My employer is in CA. can anybody advice. I don't mind checking with Murthy lawyers as well if they deal in this. thanks Link to comment
JoeF Posted September 10, 2013 Report Share Posted September 10, 2013 It depends on the wording of the contract. A penalty for leaving early is not allowed. What is allowed is asking for liquidated damages. That would generally be less the longer you work there, since any expenses the employer had, e.g., for relocation or training, would be offset over time by you working for the employer and generating income. You need to discuss your particular situation with a good lawyer. Link to comment

A contract signed by you is legally binding. But, your employer can not claim H1B fees from you as compensation. Link to comment
