L1B to H4 stamping in india US Consulate

My husband worked on L1B in US for 3.5 years where his L1B extension was filed by his company after 3 years. His extension got ddenied and he left US within 4 days after denial.

I am working for a reputed company on H1B and did not accompany him back to India.

Now after 1 month of reaching India, we want to apply for his H4.

 

My questions are :

 

1) Will US consulate see this as an issue that he wants to return to USA through another non-immigrant visa after staying for 3.5 years.

2) Will his L1B extension petition denial be considered as an issue though he returned back within 4 days for his denial.

(2) No. He could have easily applied for a COS to H4 immediately when his L1B extension was denied.
