I am on H1B Visa and came to the US on Jan 3rd 2009 and based on my calculation my validity or the 6 year mark should end sometime in Mar 2015 considering vacation time during which I was out of the country etc. I moved to a new company and my I797 approval shows a validity date of Mar 2016 which is above my 6 year mark. Also i am in my GC process intial stages so what happens if my PERM is pending for 365 days or I140 gets approved and i can legally extend my stay after 6 years but then my I797 says it’s still valid ? omshiv Posted September 9, 2013 Report Share Posted September 9, 2013 the above 6 yr mark maybe a mistake...have it corrected thru an attorney. yes..if your I-140 is approved before the 6 yr mark..your employer can extend your H1B. Link to comment
