NMK Posted September 8, 2013 Report Share Posted September 8, 2013 It's very very bad day for me.My h1b extension got denied.I have applied on premium processing, got RFE and responded the query but they denied. I have finished 6 years of my h1b, I-94 expired on july 14th 2013.I have got I-140. Please advice me. 1.what are my options to stay in US! 2.Can I appeal the case and wait for the decision. what are my chances! 3. I have to leave the country immediately. 4. please suggest me about my options to stay in status' Link to comment

omshiv Posted September 9, 2013 Report Share Posted September 9, 2013 Sorry for your situation...but I would advice you to give the Murthy Law firm a call immediately. They would suggest you on your next steps. I believe you should leave the Country immediately as you are accuring illegal presence here. What was the RFE about? Since your I-140 is already approved you are eligible to apply for H1 extension. Link to comment

If you have an employer in hand willing to give you a job and file a H1B petition immediately then contact a good immigration attorney regarding your stay here during the process. If not leave US and return when you find a new employer. Link to comment

As I said..contact Murthy Law firm right away...having 2 Vendors in between is always a problem...because they are there just to suck your hard earned $$.. but i believe unfortunately you'l have to leave the country immeidately...come back when your I-140 is approved...thats the safe way...else before going contact Murthy today and see what they say. I am surprised that after working for 6 yrs on H1 you still didn't realized that having layers in between is very risky for H1 approval. Since your I94 is already expired, I think you have to leave the country asap but contacting an attorney would be better option here. Link to comment
