You need to apply with your old approved I797 from company A and also attach your extension receipt notice

Ashish Dubey Posted September 23, 2013 Report Posted September 23, 2013 Hi Team, I am in India and I have approved H1B petition of year 2012 (valid till 2015) through consultant which is in US. My stamping is not yet done as my consultant has a fear of rejection of stamping from India. My wife is working with X company and presently in USA on valid H1B. Hence my consultant is forcing me to leave my job of India and come to USA on H4 and once I reach US he will file COS ( H4 to H1 ) for me through cap-exemption. But he is saying he will be filing my H4 to H1 through normal processing which will take min 3-4 months and during that period I have to sit idle in US and this is very frustrating and impossible for me. I have told my consultant that once I reach US if he saysI can sit idle for 1 month then he can file my H4 to H1 in premium even though he is not agree for it and behaving very adament. Hence I have decided to change my job from my consultant to other consultant and hence have following questions. 1) My present consultant has only shared my approved Receipt Number with me. So on the basis of that can I change my job to other consultant/employer? 2) In some thread I read that I can change my job only on the basis of approved Receipt Number is it true? then please let me know how to do that? 3) It would be great if Murthy or any other consultancy can help me with this as I am planning to fly on H4 in next 2-3 months. Thanks in advance. Regards, Sachin
