sapen
Hello, My H1B will expire next year and I am already on my second term. The company I am working for has applied for my GC in EB2 (Master's Degree) in March and its still in the phase of clearing labor and I dont have a status of it yet. Now I have another job opportunity and they are willing to do a H1 B transfer but will sponser GC after an year of joining. Is it advisable to take the new opportunity or stick back to where I am right now. Experts I need your advise. Thanks Link to comment
omshiv
ofcourse if you take the other job you'l have to leave the country when your H1b expires..but with your current employer, once the Labor gets cleared your employer can file your I-140 in PP and with the approval you can get 3 yr H1 extension. sapen
OK.. The current company need to match my salary with the salary they mentioned in the documentation when they actually applied for the GC. Can anyone tell me at which level will this happen? I meant after labor gets cleared? or after I140 gets cleared? Thanks for your inputs. Link to comment
sapen
Is it after I485 is approved? Link to comment
permaudit
This should happen after the PWD is cleared essentially.. Its better if you are on the same payscale when you file labor.. I might be worng, but that i how mine was done. Link to comment

permaudit
Thanks..But do you know when will PWD clear? Is it part of clearing the labor? I140 or I485? PWD will be approved before labor. You'll need approved PWD's to apply for labor. Link to comment
