H1B Visa not used : Urgent help needed

I was holding H1B (Issue date : 30SEP2007 - Expiration date : 13SEP2009) earlier which I didn't use nor visited US on H1B visa. Currently I am on H4 dependent visa (my wife holding H1B visa).

 

I am currently looking if any way of getting my previous H1B renewal or other options. kindly suggest me.

A new employer can file a cap exempt H1B petition (COS from H4 to H1B) and upon approval you could start working immediately for the new employer.

Is there any time line or period with any clauses for a new employer to file a cap exempt H1B petition. As one of the lawyer mentioned that chances are too less (>5%) getting cap exempt H1B approved.

 

 

Also I have two scenarios which needs clarification.

   1) My wife company are applying for her H1B extension and amendment request.

   2) Can I travel to India and return during her H1B extension process.

Consult the firm of Murthy or any of your choice with specifics. It is possible. You will need a good lawyer and a good employer. That will help instead of blanket statements like ' As one of the lawyer mentioned that chances are too less (>5%) getting cap exempt H1B approved"
