L1A to H1B and GC with cooling period

Hi,

 

I started off with L1B from March 2008, then converted to L1A from Dec 2012. My i-94 and visa expiration is valid until December 2014. At any cost I have to travel back next year because of visa expiration. My company is ready to apply GC for me. 

 

Please help answer my questions below.

 

1) Is it possible for me to apply GC in EB2 or EB3 and then come back with H1 or L1 post my cooling period or do i need to wait for consular processing?

 

2) If i can apply for H1B and if i travel back in 2014 december then would i eligible to apply in 2015, complete my cooling period and then come over or do i need to complete cooling period even before i start the process for H1B.

The company can file a cap subject for you after April once you have been out of the country for one full year.

Would you be working as a manager or executive while you are abroad? If so, has the company considered filing an EB1 multinational manager/executive case on your behalf after you have worked abroad for a year rather than filing an EB2 or EB3 case?

I haven't worked as manager abroad because of which going with EB2 or EB3.
