My project ended on june 31st but my biweekly paystubs have got generated till aug 1st. I currently have all my payslips generated till Aug 1st and sept 1st but the paystub for aug 15th is missing. My employer emphasizes me on generating a pseudo payroll for sept 1st and sept 15th so that i can get my visa converted. Can you please assist me on the process of H1B to h4 conversion and the grace period that i can gave once lose my job or stop working as I work on contract basis because i dont want to spend my money again for one more paystub. pontevecchio Posted September 4, 2013 Report Share Posted September 4, 2013 You should talk to a Lawyer first and then leave and come back on a H4 visa. You should complain to the DOL and assert that your employer coerced you in to accepting payslips after taking money to do so. Link to comment

Thank you very much in advance! There is no grace period for H1B. You should have applied for your COS from H1B to H4 before your project ended. You are out of status from the last day of work i.e. July 1st 2013. And, if your I94 has expired you are accruing illegal stay in US. If you apply for a COS now USCIS would require you to submit pay stubs till date. Since you do not have them your COS will go for RFE and eventually declined. Contact an immigration attorney asap. That's ILLEGAL. Your employer needs to pay you FOR REAL all the time. That's the law, and the employer knows it. File a complaint with DOL on form WH4. Link to comment
