nani1984 Posted September 4, 2013 Report Share Posted September 4, 2013 I applied for H1 transfer from A to B employer , I went for 1 day to client from A employer and applied H1B from B. while working with A employer , I signed documents saying EMPLOYEE shall pay COMPANY liquidated damages, and not as a penalty, the sum equal to 30% of the entire contract / assignment value. Now i appied H1B transfer from A to B, Should i have to pay the amount to Employer A. and he didnt ran my payroll when iam on bench. Please let me know any suggestions. Link to comment

By law your employer has to pay you even when you are on bench. You can file a complaint against him with DOL. Having said that if you had worked for employer A you are bound by the document you had signed. Link to comment
