Sat2006
Hi, Currently I am on H1B from Oct 2012. Was on maternity leave for all most 6 months. From last month I have started for looking job and searching is still ON.. In between, my employer ran pay-stubs for me (June and July 2013) by using 30% of my husband's salary (he was also with same employer). My husband left that employer last month. I requested my employer to keep running my pay-stubs until I get project. But my employer is asking for money do to the same. Here my question is, do they need to keep running pay-subs? Or they can stop doing so? until I get new project or new job ( with different employer)? Please help me on the same. Thanks. Link to comment

Employer running your pay stubs using your husband's salary is completely illegal. You will be in lot of trouble if you do not complain about your employer to DOL. Apply immediately for a COS from H1B to H4. Start looking for an employer willing to offer you a job and file a cap exempt H1B petition. Upon approval you can start working immediately. By law your employer has to pay you every month even when you are on BENCH. File COS to H4 and complaint against that FRAUD employer for not paying you. This is the ONLY OPTION to keep you in status. No doubt you will face lot of issues for not doing this. Link to comment

Finding new project is your employer's duty not your. And on H1 you have a JOB ( your H1 employer), if you doesn't then you are out of status. Link to comment
