sravzanu Posted September 3, 2013 Report Share Posted September 3, 2013 Hi All, I came to USA in FEB 2012 and then later applied for H1b visa which got aprroved and I am working since Jan 2013 , Now I am planning to go to H1b Visa stamping to Canada . So what are my chances of getting the stamping done as i have the I797 form untill 2015 and if suppose i dont get my visa can i return back to USA on H4 visa as its valid till Jan 2014 and continue working with the same I797 document. And how hard the visa interview would be for people who have transfered from H4 to H1b and What are the main documents required from the client and FYI i am working as an contractor. Please kindly any one reply to the post I would really appreciate it as it would be really helpful. Thanks. Link to comment

Well, if your H1B visa is denied and if you enter US on a H4 visa then your employer has to apply for a COS from H4 to H1B and in this way he/she has to pay entire H1B fees to USCIS. I doubt your employer would be very eager to do that. Link to comment
