I need to travel to US for 2 weeks for a training next month. Can I travel on H1B while I am still employed with Indian company or do I need to file for a B1? Should I be concerned of anything? If I can travel on H1B, is there anything the company needs to do? If I file for a B1, what happens to the H1B? Note that I still need to get the stamping done. I am planning to go to US next year for long term and would like to use H1B then. That was really the original intended purpose of H1B. Any help is appreciated. Thank you in advance. Link to comment
omshiv Posted September 3, 2013 Report Share Posted September 3, 2013 You can get the H1B stamping done and go on H1..since you'll be working with the same company in the US there's nothing to worry...once you come back to India you can then recapture the time spent outside the US back to your H1B extension. You Might have issues in getting B1 since your H1 petition is already approved. Link to comment

JoeF Posted September 3, 2013 Report Share Posted September 3, 2013 If you are not going to work for the company that filed the H1, then you can NOT enter with the H1. Doing so would be immigration fraud. You would need a B1 visa if you are attending training for your current employer. Link to comment
