H1-B AND H-4 VISA PENDING!!!!!!!!!!!!!!!!!

My H1-B extension was filed on June 13, 2013 and my spouse H-4 extension was filed separately to Texas  on July 15, 2013.  As of today, both cases are under initial review. The current H1-B & H-4  visa ends on Sept 30, 2013. If the extension is not approved before the visa end date are we out of status on Oct 1st???

As long as a decision on your petition is pending at USCIS you are at legal status.
