H1B Expiring while Extension in Progress

My h1b's expiring on 10/12/2013. I'm filing for h1b extension with premium process right now. But it seems that my employer's working pretty slow on this case.

 

So I'm worring that if my h1b expired while application for extension in progress (although I expected LCA can be approved by that time), do i have to leave US till my extension's approved, or not?

As long as a decision is pending from USCIS on your EOS application you are in status
