Possible Next steps for EB3; PriorityDate Current

Hello All,

 

EB3

PD: March 23, 2003

AOS filed- June 26, 2007

Fingerprinting done: July 2007

Currently on EAD and AP.

Since then - Nada, Zilch:-)

 

The USCIS case Status still says "Initial Review".

 

I haven't been paying too much attention to it as much of it was out of my hands until recently with the forward movement of dates for EB3.

 

Is there anything that I can do to impact or have the case reviewed. I wouldn't want to look back later and find out that there was something I could have done and didn't. What can I expect the possible next steps to be? Or just twiddle my thumbs and play the waiting game as before.

 

Any advice or pointers greatly appreciated.

Actually, twiddling your thimbs is not a bad strategy, at least for some time. Essentially, your case may be all teed up and ready for approval, or it may be stuck with some issue. There is no to very little way for you to find out which it really is other than wait and see if it gets approved within the first two weeks of the dates being current. Now, you can create a SR for long processing on the very first day your case is current to do other things (essentially, complain that the case is not approved yet), but beside being a prickish move, it may result in your case being yanked out of the "ready to approve" queue, and then being looked by a seprate officer, who may actually be ticked off at your request, and may try to "thin the herd" by nit picking at your case. I would only start rocking the boat if you for sure know there is an issue with your case that does not involve the PD. So, my advise is to wait for a couple of weeks first, then see. Another thing you can do is to take an InfoPass and simply ask if based on what the officer sees in the system you case is ready and nothing is pending.

Thanks Belle. Much appreciated. For the moment, I think I will stay put and positive. Having waited over 10 years, I guess there is no reason to rock to boat.

I am also in the same boat as yours with PD EB3 May 3,2003.The I485 received date is Sep'2007 and fingerprints are done in October '2007. Just keeping my fingers crossed to get my GC atleast this month and will be very discouraged if the dates retrogresses next month.

 

I called USCIS in May and kept a request to port my dates from 2005 to 2003 EB3 and I received response saying that my date is pointing to May'2003 and can't issue the GC bcos the dates are not current as per the visa bulletin.

 

Hoping that the officer will be able to send my GC soon.

 

Please let me know if there is any change with your case.

My priority date is August 13 2003, EB3, I485 applied in July 2007 and fingerprints are done. I received RFE in 2008 (provided all missing information same year). My status was changed to "request for evidence response review" in 2009 and still the status is same even the priority date is current. I will update if there any change in my I485 status.

I do not know whats going on but now my status changed and step back to initial review. Please someone let me know is it normal. Thanks/

Just received case alerts via email - card is in production!

 

PD: March 23, 2003

There is light at the end of the tunnel...it only took 10.5 years!!


When it is out of your hands, the only thing you can do is stay positive and hopeful.

I got a new alert this morning. The status has changed from Card production to Decision

 

On September 16, 2013, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.

 
During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

Congrats!

 

....To all those who are on their way to getting green card. Rejoice N Celebrate! Do remember that you all got it the hard way by waiting almost endlessly (and few more years to get the Citizenship). Make good use of it so that generations ahead of you will be proud Americans.

 

PS: Wish to hear these words myself when I get my card.....I am still waiting EB3, PD 22nd Sept 2003.

Finally some movement but notified via email that a RFE has been sent to all of us. Wonder what they want to know now. Meantime I was already in the process of renewing my Advance parole enable travel on Business. Can anyone guide me if I should still go ahead with the renewal (almost done) just in case I need it just before approval. I just hope they don't ask something that will require traveling back to India to procure this. Besides I don't know if they will allow me to renew my Advance Parole since they started the processing!

PD expected to be current in May 2014.
